Ban: Customer Choice Coalition
Dear
Montgomery County Restaurateur:
In September 2003, a coalition of restaurant
owners, employees and customers filed
a legal challenge against the Montgomery
County government in an attempt to halt
the impending smoking ban. Initially,
the Customer Choice Coalition sought an
injunction to delay implementation of
the smoking ban until after the courts
could decide the constitutionality of
the law. While an injunction was not granted,
the constitutionality of the law remained
the focus of legal arguments as the case
was prepared for spring 2004 court proceedings.
Since that time, however, these efforts
have been thwarted by two unfortunate
circumstances.
First, legal fees escalated
faster than had been anticipated, leaving
the Coalition unable to pay the full balance
due for fees incurred thus far. Because
smaller restaurants and bars are now facing
financial challenges, raising money for
a legal fund has become challenging for
the Coalition as well. It is difficult
to get donations from those businesses
that have been most impacted by the smoking
ban.
Second, a statewide smoking
ban initiative came very close to passing
a legislative committee during the recent
General Assembly session in Annapolis.
The Board of Officers for the Montgomery
County Restaurant Association expressed
strong concerns that the cost of continuing
the county fight could be money down the
drain if the initiative gains momentum
on the state level.
It is for these reasons that the Coalition
has filed a Voluntary Stipulation of Dismissal
for the lawsuit. While the outcome has
not been what many restaurateurs had hoped,
the industry should be proud of standing
united in the face of such drastic anti-business
legislation. We will continue to seek
financial support and use proceeds from
a golf tournament this fall to pay outstanding
legal fees.

had negative impact, tell the Council!
The
County Council Says They Have Not Heard
from Many Restaurants Regarding the Smoking
Ban
Call
or email the members of the County Council
immediately to let them know how the smoking
ban has affected your business! Also,
the “marketing assistance”
money that the Council said they would
provide through the Department of Economic
Development to help restaurants affected
by the law doesn’t exist. Yet, the
smoking ban law mandates that such a fund
must be made available. Ask the Council
to “show us the money!”
